By accessing or using Hestur AI's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

Hestur AI provides enterprise AI automation services, including but not limited to:

• Intelligent workflow automation solutions
• Real-time voice AI agents and systems
• Enterprise RAG (Retrieval-Augmented Generation) systems
• Custom AI model development and deployment
• Integration services and technical consulting

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

3.1 Account Registration

To access certain features of our services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Prohibited Activities

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services or servers
• Use automated systems to access our services without permission
• Reverse engineer, decompile, or disassemble our software

All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, and code, are owned by Hestur AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for your internal business purposes. This license does not include the right to:

• Resell or redistribute our services
• Modify or create derivative works
• Remove any proprietary notices or labels
• Use our services for competitive purposes

5.1 Fees and Billing

Service fees are outlined in your service agreement or proposal. All fees are in U.S. dollars unless otherwise specified. Payment terms, including due dates and methods, will be specified in your agreement.

5.2 Refunds

Refund policies are specified in your service agreement. Generally, proof-of-concept (PoC) projects may include money-back guarantees as outlined in the specific PoC agreement. Other services are typically non-refundable unless otherwise specified.

5.3 Late Payments

Late payments may incur additional fees as specified in your agreement. We reserve the right to suspend or terminate services for non-payment.

Where applicable, we provide service level agreements (SLAs) that specify uptime guarantees, response times, and other performance metrics. These SLAs are detailed in your service agreement and may vary based on the service tier.

Our standard SLA includes:

• 99.9% uptime guarantee for production services
• Performance targets as specified in your agreement
• Support response times based on service tier

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your data and maintaining confidentiality in accordance with:

• Our Privacy Policy
• Applicable data protection laws (GDPR, CCPA, etc.)
• Industry standards and best practices
• Your service agreement and data processing agreements

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Our services will be uninterrupted, secure, or error-free
• Defects will be corrected
• Our services will meet your specific requirements
• Results obtained from our services will be accurate or reliable

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Hestur AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute services
• Damages resulting from use or inability to use our services

Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Hestur AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in San Francisco, California.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
